Terms of Service

Last updated: 20 October 2026

About these website terms

These terms apply to use of the Fabex Properties Ltd. website, including its property listings, service information, and enquiry facilities. Please use the website lawfully and read these terms alongside our Privacy Policy. Browsing the site does not create a property purchase, investment, construction, advisory, or management contract. Any such engagement requires its own agreed terms.

Our properties and services

Fabex introduces land, homes, and other property opportunities and provides property advisory, construction, and management support. The type and availability of a listing are stated on its page and should be confirmed with our team. Descriptions of our general services do not mean that every service, location, or property is available on the same terms.

Listings, photographs, and concept images

We aim to present property information clearly and correct material errors when identified. Some images are generated architectural or landscape concepts; brochures and other media may also illustrate proposed layouts or facilities. They are not a representation that every pictured feature exists, is approved, or is included in a sale. Ask what is existing, proposed, and contractually included, and inspect the actual property before deciding.

Prices, fees, and availability

Website prices are expressed in Nigerian naira unless stated otherwise. A displayed price may be a starting price or a pre-launch offer for a specified property or plot category. Confirm the current price, exact area, availability, applicable taxes, documentation costs, infrastructure or development charges, and any other fees in a written quotation. A listing is an invitation to enquire, not a binding offer or a guarantee of availability.

Payment plans and written agreements

Where available, the advertised 3-, 6-, and 12-month plans are options to discuss rather than automatic credit approval. The applicable deposit, instalment amounts, total price, due dates, allocation conditions, and any late-payment provisions must be stated in the relevant written agreement. Do not assume the cash price applies to every instalment plan. An enquiry, brochure download, inspection booking, or verbal discussion does not replace signed transaction documents.

Title, surveys, and due diligence

A reference to a Deed of Conveyance describes the documentation identified for that listing; it does not by itself prove ownership, an unencumbered title, planning approval, or completion of any necessary registration or consent. Request the relevant title and survey records and obtain independent legal or professional checks suited to the transaction. Confirm boundaries, access, permitted use, and any known restrictions or encumbrances before committing.

Inspections, reservations, and allocation

Contact us to arrange an inspection or ask about reservation requirements. An inspection request is subject to confirmation and does not reserve a property. Reservations, allocation, handover, and possession depend on the agreed documents and conditions, including any required payment and verification. If you are buying from abroad or through a representative, confirm the authority, documentation, communication process, and inspection arrangements in writing.

Payments and protection against impersonation

This website does not currently accept online property payments or collect payment-card details. Confirm the company’s payment instructions through an independently verified contact channel before sending funds, and request the appropriate written acknowledgement. Do not send passwords, one-time codes, or banking access credentials. If instructions change unexpectedly, pause and verify them directly with the company.

Cancellations, refunds, and transfers

Any deposit, cancellation, refund, substitution, resale, transfer, or allocation arrangement must be explained in the relevant quotation and agreement before you pay. These website terms do not impose a blanket non-refundable-payment rule or replace any applicable consumer rights. Ask our team to clarify unclear charges or conditions in writing before committing.

Advisory, construction, and management work

The scope of advisory, construction, or management support, responsibilities of each party, fees, budgets, milestones, approvals, reporting, and completion or handover arrangements should be agreed separately in writing. Website descriptions and concept designs do not constitute a completed design, building approval, cost guarantee, or construction programme. Material changes should be documented and agreed through the process set out in the service agreement.

Investment information and independent decisions

Property values, demand, resale prospects, and rental income can change. We do not promise a particular appreciation rate, return, resale period, or rental yield. General website information is not personalised legal, tax, financial, surveying, or planning advice. Consider your own circumstances and seek appropriate independent advice when assessing a transaction.

Responsible use and intellectual property

Do not interfere with the website, attempt unauthorised access, impersonate someone else, scrape personal information, or submit unlawful, deceptive, or harmful material. You may view and share links for personal property research. Fabex branding, text, and original media, and any third-party content, remain subject to the rights of their respective owners. Ask permission before reusing materials commercially or presenting them as your own.

Privacy, external services, and availability

Our Privacy Policy explains how we handle website enquiries and team-account information. WhatsApp, social-media, email, and map services operate under their own terms. We aim to keep the website available and useful, but maintenance, technical problems, or third-party services may interrupt access. Please contact us to confirm important information if a listing or page appears incomplete or inconsistent.

Responsibility and resolving concerns

We remain responsible for duties that apply to us under the law and any agreement we enter into. Nothing in these terms excludes liability that cannot lawfully be excluded or takes away non-excludable consumer rights. If you believe website information or our handling of an enquiry has caused a problem, contact us with the details so we can investigate and seek a fair resolution. You retain any right to approach a regulator or a court with jurisdiction.

Applicable law, changes, and contact

These website terms are governed by Nigerian law, subject to any mandatory protections that apply to you. Disputes may be brought before a court with jurisdiction; these terms do not require mandatory arbitration. We may update these terms for future use of the website, with the revision date shown above. An update does not retrospectively change a signed property or service agreement. Contact our team for clarification before relying on any point that affects your decision.
